Chronology of Jerry Wayne Morgan
In 1998 I began writing to Jerry Wayne Morgan, at first I did not know
that he would get 25 to life, and be sent to High Desert State Prison.
His charge was battery on co-habitant, and she had a very slight injury.
There is a little tiny mark under the inside corner of her right eye (left
side of picture).
When he was first put in Jail he had major heart surgery, and after 24 hours was taken out of hospital and put in a jail cell, with no pain medication or any follow-up. He finally a long time later had a check up at High Desert, but never did get the medication he was to take the rest of his life. On October 9, 1998, The Third Appellate District made a ruling that, "The petition for writ of habeas corpus has been treated as an application for relief from default for failure to file a timely notice of appeal in Shasta County No 97F9169 and as such is granted." Court Appointed Attorney S. Lynne Klein of Davis, California, wrote a letter where she told Jerry that she had filed a Wende case, and she stated that she did "not believe there is any reason to think the court will find anything that will help." People v. Wende, (1979) 25 Cal.3d 436. The Supplemental Brief was filed by April 28, 1999, and the hearing was set for June 18, 2001, and the decision was Certified for Publication on July 16, 2001. This was a Three Strikes case where the Justices totally overturned the "judgment and sentence" and "defendant's plea is set aside." http://www.geocities.com/three_strikes_legal/Morgan_brief.htm He was released from prison at Calipatria, and returned to Shasta County Jail. They acted like he had won nothing, and he sat in jail for about 14 months. April 22, 2003, Jerry Wayne Morgan, the first Three Strikes case to be overturned, took a plea for time served [over 5 years] in order to obtain his freedom. The Judge had ordered that he will be released from Shasta County Jail. I attended the hearing on Monday, April 21, 2003, and overheard some of the negotiation between the Deputy District Attorney Woods, and Attorney Richard Maxion. Woods would not budge an inch on time served, as the Penal Code §273.5 that he was forced to plead to happened in Tehama County, Shasta County never had jurisdiction to even charge him with this crime. In Court Morgan was told to report to Parole, but no mention to how long he would be on parole. I went to his Attorney's office several times to get a copy of the Order and was never able to get a copy, and Morgan was never given a copy either. When he went to parole, they had no CDC number and he was not in the system, so she would do nothing to help him survive, so he had to go to the Good Will Mission. This went on for a couple months, and when he got enough money to buy a Bus ticket he took off for Arkansas. He was very mental damaged from prison, having a hit placed on him at High Desert, which missed killing him by a inch as he showed me his scar. In Shasta County Jail he was badly beaten when he refused to double cell, he was in medical for a month and they would not take him to the hospital. http://www.geocities.com/three_strikes_legal/in_the_hole.htm May 26, 2005, called the Poinsette Jail in Arkansas, where Jerry Morgan is an inmate, awaiting extradition back to California for Parole violation. So now California will spend thousands to bring him back, and about $30,000 a year for maybe 5 years, for someone who got in a domestic dispute with his live-in common law wife. The Third Appellate threw out the two priors, and they coerced him to plead to one of them again, a clear violation of the Third Appellate Opinion. July 1, 2005. Received a letter from Jerry Morgan, still in the
Poinsette Jail, at Harrisburg, Arkansas. He states that the Judge
has no authority over parole, only CDC has authority over parole.
The Judge could sentence one to probation, but this was not done.
Usually the parole is 3 years, and the Judge ordered 5 years of parole,
when the sentence had been over-turned by the Third Appellate Court.
Governor Arnold Schwarzenegger has signed a warrant, but Morgan has been
sitting in Arkansas Jail since May 2005, and since California has never
picked him up. Is California paying for the stay in this Jail?
